Terms and Condition
for Prospective Tenants
1. Commission-Free Placement Services for Tenants
The brokerage services of agent home gmbh are free of commission for the tenant, according to § 2 article 1a WoVermRG (Act to Regulate the Real Estate Brokerage).
2. Rental offers
The tenant will receive rental offers from agent home via telephone or via e-mail. Should the tenant already have knowlede of an offer, he must inform agent home immediately an, if requested, provide proof of his previous knowledge.
3. Confidentiality of rental offers
The tenant may not disclose rental offers he received from agent home to any third parties. The rental offers are intended for the tenant alone. In the event of unauthorized disclosure, the tenant may be liable for damages (if the unauthorized disclosure of the rental offer intended for the tenant results in agent home no longer being able to successfully rent out the apartment).
4. agent home is not part of the rental agreement
The contractual obligations according to the rental agreement apply only to the tenant and the landlord, not to agent home. agent home cannot be held responsible by any of the parties for a violation or breach of the rental contract.
5. Duty of disclosure
a. The tenant is obligated to fill out the registration of his apartment search truthfully.
b. If the tenant concludes a rental agreement, either orally or in writing, for a property that was offered to him by agent home, he must notify agent home right away (no later than within 24 hours) and upon request provide agent home with a copy of the rental agreement.
c. If the tenant extends the lease beyond the initially agreed upon rental term, once or multiple times, he must notify agent home right away and in advance, and provide agent home with a copy of the rental agreement, if requested.
6. Credit check
The customer agrees to his/her details, provided in the course of the initiation and transaction of a rental agreement, being transmitted by AGENT HOME. to SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden for the purposes of checking, so that it may obtain information about the former. This consent may be revoked by the customer with future effect. Regardless of that, AGENT HOME. will also transmit data to SCHUFA on behalf of the landlord as a result of behavior in breach of the agreement ((e.g. amount outstanding after legal enforcement following a termination under Sections 543 (2) No. 3, 569 (3) of the German Civil Code (BGB) or on account of default in payment under Section 573 (2) No. 1 BGB)). According to federal data protection law, these notifications may only take place insofar as this is permitted after considering the interests of all stakeholders. The customer may request information from AGENT HOME. at any time in relation to which credit reporting agency has been sent data about him/her. 7. Applicable Law
For the broker request of the prospective tenant, the laws of the Federal Republic of Germany apply.
8. Stutttgart is the exclusive place of jurisdiction.
